Wrongful birth or life lawsuits are litigation filed on behalf of parents who have a child with a disability, disease, or other condition that they claim should have been disclosed during pregnancy but was not, resulting in a wrongful birth or wrongful life. Essentially, the premise of such lawsuits is that it would have been better, for either the parents or the unborn child, for a fetus that would have been born with a disability if carried to term to have been aborted instead of born. This issue strikes a major chord in the disability rights movement, of which I am a "member" (as much as you can be a member of a social movement), because these lawsuits ultimately devalue the lives of people with disabilities. Parents who sue with this cause essentially state in public that their now living child should never have been born.
What do you think? What do these lawsuits say about the lives and rights of people with disabilities?
